Psychological harm in the workplace

Tasmanian employers have a responsibility under the Work Health and Safety Act 2012 (Tas) (WHS Act) to identify, assess and manage risks to workers’ health and safety arising from employment, including risks of psychological harm.

The High Court made clear, in its recent decision in Kozarov v Victoria [2022] HCA 12, that employers will be held to account for failing to implement preventative measures to protect workers from inherently psychologically dangerous work or workplaces.

Safe Work Australia has produced practical guidance to assist employers to meet their duties under the WHS Act in respect of psychological health and safety, including steps to identify particular psychosocial hazards which you can download here.
