As the use of Artificial Intelligence (AI) becomes more prevalent, lawyers must remain vigilant of the dangers of relying upon AI to assist with legal tasks such as legal research.
In a recent case, a Western Australian lawyer has been referred for disciplinary action after submitting a document to the Court containing fabricated legal principles generated by an AI tool. The lawyer relied upon ChatGPT to prepare a response to a complaint, which included references to cases that were either incorrect or did not exist and misleading legal arguments.
The Legal Practice Board of WA found the conduct fell significantly below professional standards, emphasizing that legal principles are not mere slogans and must be applied with diligence and accuracy. The incident highlights the risks of relying on AI without proper caution in legal practice.
